I remember May of 1959.  I was still in Kindergarten at the time, and I remember hearing a howling siren going off.  All I knew was that it wasn't the  Fire Drill whistle.  All of us were told that we were to follow our teacher to the basement as quickly and quietly as possible.<br />
The Principal had pulled  a G-D D**NED AIR RAID DRILL!<br />
I remember the gray cinderblock walls and boxes with a red cross on them.  The most horrible thing was a picture of a bright yellow circle with black triangles on it.<br />
The Nuclear Fall Out Shelter sign.<br />
FAIL SAFE is just as relevant today as it ever was.  Only the weapons have changed. People, sadly, have NOT.<br />

<p dir="auto">The President would have known his political career would be over by nuking NYC, he will definetly be impeached and ousted out of office possibly arrested for murder. He had sacrificed the rest of his life in order to save the USA. Remember it was 'our' screw up that caused this problem in the first place, so it was up to us to solve it without provoking an all out nuclear war. He did what he had to do in order to save the USA,USSR and just about the entire world.<br />
In 1964 I was a teenager and the threat of a nuclear war was on just about everyones mind. In school we had air raid warning drills, the 'duck and cover thing', in Chicago where I lived every Tuesday at 10:30 AM air raid sirens went on to test the alert system. It was a very different time back then, a lot of people who read the book or saw the movie thought nuking NYC was an alternative to an all out total destruction. It's not a matter of liberal or conservative thinking, it was fear that ruled then. The Japanese in WWII after two nukes were dropped there decided to surrender rather than their entire island devastated.<br />
It's like the saying, the needs of the many outweigh the needs of the few. In todays climate the scenario of this book/movie is not relevant as there isn't any USSR any more and world leaders are aware of what a nuclear exchange would do. Except for that nut-job in North Korea and a few Middle East wackos it is not the threat it once was.</p>

<p dir="auto">He probably would <a href="http://be.it" rel="nofollow ugc">be.it</a>'s almost a textbook definition of treason as defined by our constitution. (Including the necessary number of eyewitnesses.) IIRC, the 2000 version subtly implies the president commits suicide afterwards as well.<br />
But who knows what the political situation would be after the movie ends.. in the chaos that would follow, martial law would probably be invoked and it could be years before it's withdrawn, if ever.<br />
FWIW, I don't think any president would ever nuke NY, no matter how enlightened. That plot point is not realisticnor was it intended to be, I think. I think the resolution here is more to make the point that a mechanical error in either nation's nuclear protocol would set off a chain of events that would have a life of its own, and couldn't be stopped no matter what good intentions the leaders might have.<br />
Two other points raised by commenters:</p>
<ol>
<li>Negotiating a truce with Russia. The more you think about this, the more ridiculous it seems. In a lightning-fast game of nuclear chess, the Russian president is supposed to rely on the promise of restitution that must be put through the ringer of Congress? And no amount of restitution could make up for the loss of lives and infrastructure which the USSR would lose.<br />
I mean, even if the U.S. could guarantee those dollars, it would take months, years to repair the damage. What would happen to the Soviet bloc during that time? (Or would part of the deal be that America promises not to support anti-Communist efforts in Europe, or even to use their military to stifle them?) Anyway you slice it, such a move would mean America is victorious in the Cold Warso it kinda easy to see why Russia would rather resort to nukes than agree to restitution.<br />
It's like negotiating the price for someone to kill you.</li>
<li>Re: D.C. v. NY. Nuking New York makes sense because it's the economic center of Americaobliterating it would do massive economic damage to America's economy and its basic infrastructure. (Also, obviously, it would cause the most loss of life.)<br />
It's a roughly fair trade since the U.S.S.R. had time to move its government leaders out of Moscow to continue the continuity of government.</li>

Fair enough the fact that a faulty order was received is indeed an accident, but if the world power wouldn't toy around with nuclear weapons it wouldn't have happened. It's like a person driving drunk and causing an accident. The crash itself was certainly not on purpose, but if it weren't for driving drunk in the first place it probably wouldn't have happened. I haven't watched the 1964 version yet but in the 2000 version Sam Elliots character said some true words:</p>

<p dir="auto">The original poster has a point.  Not that the president would be arrested for treason necessarily, but there would almost surely be a lot of political "fallout" over his decision to bomb New York.  Politics is a dirty game.<br />
He might at the very least be asked to resign, or he may resign on his own.  Sort of like the pilot using the suicide pin at the end of the movie.  Would he even want to continue leading the country after causing the death of all those people?  No matter how worthy the cause?<br />
I've watched this movie several times over the years, ever since I was a kid.  But this aspect had never occurred to me.  I had always thought about the president's wife being killed, and all the other people, but I had never considered the political consequences to the president, and how he would face them.<br />
Maybe there's room for a sequel here.</p>

<p dir="auto">You couldn't possibly be any more wrong.  You are exactly like those nitwit airmen at SAC cheering whenever Group Six downed one of the Russian planes.<br />
While there may be other ways to provide the Russians with restitution, there are no ways to do it immediately, in the heat of the moment, with the Russian Generals breathing down the Premiers throat for vengeance.  A promise of money, or land, or aid is not going to satisfy them.  Not right at that moment.<br />
Think about it - if the Ruskies had just nuked NYC - or some other large city that you actually do care for - and I mean 5 minutes ago, would a promise of money satisfy you?  No, of course it wouldn't.  And it sure wouldn't stave off the generals who would do whatever they could to take out Obama or whoever was the President and launch the missiles and subs and other Group Sixes themselves.<br />
A final note is that General Black had seen this thing develop; he knew what was at stake from having just been discussing it at great philosophical length, and he knew that he would be saving tens of millions, perhaps hundreds of millions, by dropping the bombs on NYC.  A concept you obviously can't grasp.<br />

<p dir="auto">This film was made in the pre Watergate, pre Vietnam, just after the Cuban Missile Crisis USA.  The President chose NY because the Russian delegate was there and because his family was there.  Remember this was all about convincing the Soviet PM that the President was sincere.  By their guy being there and sacrificing his family and NY being our largest city at the time it was done to satisfy the Soviet PM, and those in their government pushing for an all out nuclear exchange.<br />
The President wouldn't have been charged with treason or asked to step down.  Doing so would have the appearance of a coup having taken place immediately after a nuclear exchange.  No way would the government of that time take that risk.</p>

How does this help your argument?<br />
You seem to be assuming that an oath to "preserve, protect and defend" the US Constitutionthat is to say the law and the governmental system of teh United Statesis the same as an oath to "preserve, protect and defend" the PEOPLE and TERRITORY of the United States. Where in that oath you cite does a president swear that?<br />
I ask that because in the past week or so President Obama  has revealed to us that the lawyers of his Administration have crafted a memo in which they have concluded that it is perfectly legal and proper for a president to order the killing of US citizens, Hence he can order drones to go out and kill American terrorists in non-war zones like Pakistan and Yemen. All for the good of US national security, of course. If US law and national security priorities allow killings of that sort, what do you imagine that says about the legality of the president's action in Fail-Safe?<br />
One thing you CAN be certain of: if such an action ever DID occur there will very quickly be a memo crafted by some White House lawyer assuring the nation that the president's action was all perfectly valid, proper, and legal. If George W Bush could draft the lawyers in to help him out on the torture issue and now Obama has done it with drone assassinations, a similar memo in the aftermath of such an action would be a certainty.<br />
More to the point here, that memo of Obama's is a direct challenge to your own argument that "you don't kill your own people under any circumstances". As indeed was Obama's actions in using US drones to kill US citizens suspected of terrorism. If "you don't kill your own people under any circumstances" truly is US law then Obama's actions would be just as illegal as you claim the presidential action in Fail-Safe is.<br />

What do you imagine a president is doing when he sends American troops off to fight a war? Some of them are almost certainly going to die. Those deaths may have come from enemy fire, but they would nevertheless have also been a consequence, albeit less directly, of the president's decision to send them off to wage war in the first place.<br />
(BTW, isn't there an old Russian(?) folktale that bears on this? About a sleigh being pursued by a pack of hungry wolves and the passengers having to be sacrificed one by one to save the rest?)<br />

<p dir="auto">One answer would be to point to all those other atomic bombs and missiles the US has stashed away in readiness against just such a scenario. The ones which would blow up large swathes of the rest of the Soviet Union.<br />
A second response would be to point out that it would be what's called a calculated risk. President Truman took that same risk when he had American planes drop atomic bombs on Hiroshima and Nagasaki. Such mass murder could have galvanised the Japanese to resist even more steadfastly than they had up to that point. Truman took the risk that they would not.<br />

That novel was written by two guys with Ph.Ds in political science, Eugene Burdick and Harvey Wheeler. One of them (Wheeler) was a full professor in that craft at Washington and Lee University. They presumably knew at least a little about national security.<br />

<p dir="auto">And yet they presumably would have no problem firing missiles and sending bombers to kill millions of Soviet citizens even though they would surely know that, by doing so, they would provoke an attack from the Soviet Union which would result in the killing of millions of Americans (not to mention a few less consequential sorts like Britons, Frenchmen, Germans.)<br />
Would it not therefore follow from that (and your own logic) that they would have refused to obey a presidential order to launch a first strike against the Sovietson the ground that hy doing so they would killing millions of Americans?<br />
That's one response to your argument. Another would be to ask just what is the penalty for military officers who refuse to obey a direct order from a superior officer? For example, their commander-in-chief. Especially if, by doing so, millions of Americans get killed thanks to an atomic war that could have prevented had those officers obeyed that order.<br />
Which, of course, begs another question: if it came down to a choice between wiping out one American city (New York) and having much of the rest of America wiped out by a vengeful Soviet Union retaliating for what they would doubtless see as an unjustified and unprovoked attackjust as America did following 9/11. Did America take it on the chin and do nothing in response to 9/11?</p>

<p dir="auto">You don't kill your own people under any circumstances. Whats to stop the Russians from attacking anyway even after NYC is blown up? It would never come down to that anyway. The "deal" made to destroy NYC was an idiotic plot device put in by the screenwriters, who probably knew nothing about national security.<br />
The Russians would either retaliate fully or demand restitution for the accidental attack. No member of the joint chiefs or armed services would ever obey an order to kill millions of Americans. The Russians would have had to do it themselves.</p>

<p dir="auto">The reason for what the President did, and when he did it, was because both sides had hundreds, if not thousands of nuclear missiles aimed at each other, ready to go off at a moments notice.  If the situation were reversed, would you sit around for weeks while the Russians debated how much to send us if they nuked NYC, even by accident?  Unless something concrete was done immediately, we would have retaliated.  No reason to think the Russians would have done differently.<br />

<p dir="auto">It is the "last resort" only in the minds of the filmmakers.  It is a false choice. There are other ways to provide restitution to the Russians for accidentally attacking them.  No way does killing millions of additional innocent people make any sense whatsoever. The Russians would be better off by accepting billions in restitution and aid. What benefit would they get out of Americans dying by the millions?<br />
Who is to say the attacks would even have parity?   We would certainly lose more lives than the Russians would. Nuclear bombs aren't exactly precision weapons.   The fallout would harm other nations not even involved.  The entire notion a president would do that to his own citizens is asinine. Nobody would bother with arresting him for treason, he would be gunned down like a dog in the street.<br />
A final note is that no military man at any rank would ever obey an order to bomb NYC.  They swore an oath to uphold the Constitution and protect Americans from all enemies, foreign and domestic. Nuking NYC wouldn't exactly fit within that.</p>

<p dir="auto">Of course, in the events of Fail Safe, they do have evidence: the smoking pile of dust that used to be Moscow.<br />
So if Bush were in a similar situation, we wouldn't have to depend solely on testimony and records. A nuked-out Bejing would offer pretty good evidence that he wasn't making it all up.</p>
