It seems like he maybe hesitated after sizing up Pee-wee and determining he was too pure and innocent to hear about stabbing a person to death so made up a story about cutting off a tag. Or else the world Pee-wee inhabits is so absurd that somebody could be jailed for that. But I think the humor of the movie is that Pee-wee is an absurd creature in a less absurd world. Doesn't really matter, I guess.
