That's the great thing about taking over, no consent is required.
Besides, we traded them some nifty beads, smallpox, and casinos for their land. They certainly did consent, but then regretted their poor bargaining skills later and wanted to renege (another racist phrase but that's another story) on the deal, thus the term Indian giver was coined.
