<p dir="auto">Misrepresenting ones identity in order to have sex is a form of statutory rape, in all 50 states.  For the exact reason you stated many times. That if a woman consents to having sex with Lorenzo von Matterhorn, or Sean Connery, or Neil Armstrong, that is not consenting to have sex with Barney Stinson. It is statutory rape.<br />
I have no idea how often this actually happens, and further, how often anyone bothers to prosecute it, but it is indeed rape.<br />

<p dir="auto">Not sure why you thought your reply deserved it's own thread. As a lawyer I can tell you, you're a 100% wrong. Many states do not criminalize most cases of Rape by Deception (27 of 50 do not). The only case that is commonly criminalized is if you pretend to be there spouse. Lying and saying you're a billionaire to some girl at a bar won't count. At least Google something before you make wild claims. Here's New York Rape Law:<br />

A person is guilty of rape in the first degree when he or she engages in sexual intercourse with another person:<br />
By "forcible compulsion"  compelling the victim through the use of physical force or the threat of immediate death, physical injury or kidnapping;<br />
Who is incapable of consent by reason of being physically helpless;<br />
Who is less than 11 years old; or<br />
Who is less than 13 years old and the defendant is 18 years old or more.<br />
Show me which section criminalizes Rape by Deception?<br />

The context shouldn't matter; there shouldn't be anything about one person taking advantage of another for sex, that should be relatable or funny, and it's disturbing to suggest that there's a situation where it can or should be taken lightly.  I mean, for crying out loud, they did an episode where Barney not only copped to posing as a doctor, offering free breast exams, in order to sleep with women; he then followed that up posing as a lawyer representing a class action suit against the persona of the admittedly fake doctor.  The whole premise to his "spin-off", prompted by the original scheme being so "successful," was to target women he'd slept with who felt violated by his pretense, and were willing to seek legal representation against him; all so he could take advantage of these women a second time.  That's the behavior of a predator, bordering on a serial rapist.<br />
