I wonder how many discs will fly out of windows when unsuspecting buyers discover that the well made Bat-costumes in the cover are nowhere to be seen! This is flat-out false advertising.

Probably the same number of discs bought by consumers too hasty to look at the back cover which clearly shows B&W clips of the series, and which has the standard info at the bottom indicating the product is in Black & White.

Not quite. They used painted images in most movie posters of that era, but there was often a photo insert from the serial or there were lobby cards inside the theater, showing various scenes. It's fairly obvious that the DVD cover images were chosen to appeal to the younger audience who only know the modern Batman productions. Even the Adam West film DVD had it's cover redone to take the image of West and Ward off the front cover and replace them with a bat symbol. It also tends to make you think that the action is more like that of modern films, when it mostly consists of fist fights and car chases. Let's face it, Republic was a bit more inventive in their action sequences. There's no Yakima Canutt here, like in Zorro's Fighting Legion.
"Fortunately, Ah keep mah feathers numbered for just such an emergency!"
