I also thought of him as the next Batman villain right away, but not as the Penguin, but as the Ventriloquist, Arnold Wesker. That character would f16d0it in more neatly with the new franchise than the Penguin. Giamatti would be pretty good for the Ventriloquist, too.

I can't believe that Nolan thinks the Penguin couldn't fit into the current vision of Batman. He could easily be a well dressed gangster who may walk in a strange way or just has the nickname 'penguin.' It would be quite a straightforward villian.

Nolan isn't signed up for a third film, only Bale, Caine and Freeman (I think) are. If another film is made, no doubt Nolan will be apart of it though. And I don't think characters like Penguin will make it in. Just my honest opinion, but he's not very interesting. The Tim Burton version (not much like the comic version, by the way) was good for it's tone of movie that was Batman Returns. Not in a realistic setting.

I think the Penguin could be made very realistic as a Carmine Falcone type mob boss who comes over from British organized crime and goes insane in the chaos of Gotham. I had never thought of Toby Jones before in that role, but I could really see it. For some reason, I have this image in my head of Ben Kingsley with a prosthetic nose.

The "real" Penguin in the comic books is a cold British-style gangster to be taken seriously, perfect for the Nolan universe. Ignore the ridiculous Burton version, which basically took the name and created its own character for a poorly written storyline. Bob Hoksins would be the ideal choice, but not the only choice.

He needs to play a villainany villain, whether it is a proper Penguin (which the cold, british mobster has NEVER been a part of any adaptation I've seen, not just Burton's fault. See "Burgess Merideth for more info) or as anyone else, within reason. Sure, he's not gonna be Maxie Zeus or Mr. Freeze, but even Riddler would be a good choice. Hell, him as Penguin and David Tennant as the Riddler and I'll forget The Dark Knight existedand I adore that film.
That's my belief and I'm sticking to it. -
