As to David Ware, he was given 50 chances to exit his vehicle, but refused. He killed the officer because he didn't want to go to jail. He was convicted by a jury of his peers, and the JURY recommended the death penalty.
Personally, I hope he is executed, and that this will serve as a deterrent to others who break the law and then refuse to comply with police orders. If you disagree with a police officer's instructions, you do NOT shoot him. You

in court.

You’re right. He didn’t want to go to jail. The armed officers were going to force him to do just that. He had no choice but to shoot them.
Ware have the officers 50 chances to leave him alone. He gave them 50 chances to only write him a citation. The officers did not comply.
What is aware supposed to do? He already said no to jail. That wasn’t an option. He said no. No means no. These two men used weapons on him first.

Police shoot and kill their detainees all the times. And they have a significant advantage. Most of the time, it’s rules justified. The cases that do make it to the court level are often dismissed.
Ware manages to shoot two cops as a detainee. Do you know how hard it is to do this without being shot? And he isn’t rewarded? He’s punished? He deserves a statue.
All aside, let me be objective for a moment.
Luigi Mario snuck up being this guy and shot him. He was the direct assailant.
Ware shot the officers as a result of the officers’ choosing to confront him.
The equivalent would be if Ware snuck up behind these officers and shot them at an unrelated stop, when he wasnt being detained.
Luigi getting 2nd degree and Ware getting 1st degree - it should be switched.

I’m saying not wanting to go jail is a valid reason to have and defend yourself against. If an officer is taking you to jail and your only chance to escape the forcible situation is to shoot him then it is what it is.

That’s the problem.
He killed an officer to get said officer to stop bothering him. He killed said officer as a last resort only when officer became physical. He neutralised the threat that was facing him at that moment. That’s not first degree murder.
If it had been two carjackers instead, it would be ruled self-defence. He pleaded with the carjackers to leave him he several times and only resorted to lethal force when one carjacker grabbed him with intent to kidnap him. Officers who are detaining people should not be exempt from allowing people their natural human instinct to defend their property and life against force.

People can resist “arrest” just as much as they can resist a robbery.
Being threatened with “arrest” is just as much of a valid threat as anything else.
Officers are literally implying
You must do as I say, and allow me to restrain your arms, and get in the back of m vehicle, or I kill you.
That’s a threat where use of self-defence is applicable.
It may not be legal, but we certainly can’t blame people for wanting to defend themselves against an arrest. It’s like trafficking. It lasts a long time. It’s scary for anyone.
