Thornton could have had Dr. Barbay by the short and curlies. When Barbay had Marge dictate his message to Thornton, it would have been on record that Barbay would not pass him no matter what. Thornton could have used this against him to accuse Barbay of academic fraud.

No, he said, "You will never, ever pass this course." I think he doesn't like the fact that Mellon bought his way into the school by giving the school a check. If he had actually been a hard worker going back to school, it might've been different.

I think the matter would have been pretty easily settled when whatever judge oversaw the case got a look at Melon's grades. Had Barbay failed him, there would have been plenty of evidence to prove he was a lousy student.
