Rights for using the name Nuclear Man

Before this film was made, there was already a comic book character called Nuclear Man. He was a high school student Ronnie Raymond and Nobel Prize-winning physicist Martin Stein who were caught in nuclear accidents that allowed them to fuse into the "Nuclear Man" I wonder why there was no problem with them securing the rights to use the name Nuclear Man in this movie. Very strange.

Marvel and DC both have a CAPTAIN MARVEL, so there's probably some trademark issues at work. Unless there were problems, and no ones ever mentioned them.
