It didnt matter if he raped her or just beat her. She was afraid to testify because of the questions she would would be required to answer.

Is it true you went to bed with a man you met only 20 minutes before? Now why is it, miss, that a smart and innocent girl like you would agree to get mixed up with a felon? Smart girls don't tend to do those things, miss"
This is how the system operates. Very rarely are the victims of abuse given the benefit of the doubt in court. The victims are usually grilled in front of an audience, forced to explain and justify every action they took that may have led to their attack. It's something not many victims like to do. -

I don't know how old the people posting about this are, but there seems to be a lot of naivete about rape trials in these comments.
She had worked in the legal system and knows not only that she'd be the one subjected to scrutiny and accusations of promiscuity, but that it would be her colleagues doing it. She mentions how with other cases she sees her co-workers laughing and joking about such cases afterwards. She can't handle not only being victimized a second time, but also the humiliation of suffering this at the hands of people she knows. -

That doesn't matter. All she had to do was tell the cops Max Cady beat her, broke her arm and bit her face. The cops can see the injuries. They would see Cady had a record and arrest him. All that other stuff wouldn't matter. It wouldn't matter she was drunk or what she was wearing. All she had to say was, "I'm an adult. I was at bar, I went to have sex with a guy I liked. And when we got to his room, he attacked me." That's all she had to do. The issue with rape cases, is if all you have is proof that a sex act took place, it's a 'he said, she said' about whether it was consensual or not. But with her injuries it wouldn't matter. No one consensually has their arm broken.

Talking to the cops wasn't all she had to do. They make the arrest, not the conviction. She would have had to testify in court and the defense team would have put her through hell. Irrespective of whether or not it's a rape or assault conviction they were going for, she would have had to detail everything that happened that night and have dealt with the judgement and accusations from those who would have blamed her for putting herself in such a dangerous situation. The fact that this would all play out right on front of her colleagues was just too much for her and it would have followed her around for the rest of career. Trials can drag out for months or even years, she just wanted to get the hell out of there and try and move on with her life. -

I think that it is very unfair to say that Marty only cast Illeana Douglas because they were in a relationship . She is a very talented actor and I think her performance in this movie was outstanding.
