    Driving so close to the driver in front and not even paying attention to the road even though the car in front cut him up moments earlier.far too casual driving.m But it is only movie making and attention to detail isnt that neccesary on the film makers part.
    Also why did they get crashed into again when their car was upside down? Surely the driver behind Kale and his father had time to stop, unless he was tail gateing Kales car as well?

          I agree as well. He could be partially blamed for the accident, so that's enough guilt and weight on his shoulders.

            It's true, it was pretty reckless driving on Kale's part. I suppose there is a message somewhere in there about teen drivers but I guess that doesn't really matter.
            As for who is responsible, there is plenty of blame to go around: The truck driver was driving a bit fast for the road and swerved out of the way of the car at the last second, Kale was following the truck too close and actually had a few seconds to also swerve out of the way but he wasn't looking at the road and last but not least, there was plenty of room on the opposite side of the road for the broke down car to be safely out of the way of traffic.
            Oh yeah, the car that crashed in to them was coming from the other direction, not behind them.

                Yeah, I felt that scene to be really suspicious, IMO. Yes it was reckless driving on Kale's behalf. But just the way both the black and red car handled itself seemed way too shady.
                The 2nd car that crashed right into Kale's totaled-car didn't even stop and kept speeding. And it seemed to be going at a ridiculous speed in a linear direction. I think that both the black car driver and the 2nd red car driver were intentionally trying to knock Kale's car out of balance somehow.
                In my opinion the black car intentionally veered into Kale's lane so he could block off his peripheral vision for the upcoming car ahead that was paused further down the lane. As soon as the black car turns (suspiciously without signaling AND at the last minute) this gives Kales car the split second opportunity to turn into the other lane but it was too late - which was exactly what the black car driver was expecting.
                They should've elaborated at least a bit further on the true nature of the C.O.D but I think that it would only detract the basis of plot and theme of the film. As the true cause of the car crash wasn't really important but Kale's loss and grief of his father and pressure in his new town. So I'm assuming why they left it out. None the less it's highly suspicious.

                  your an idiot. kale was driving normal.
                  he was driving the speed limit the guy behind him sped up to get around kale.
                  then obviously slowed down. it wasnt his fault it was the guy in front.
                  they got in the accident right after they turned the corner the truck that hit them was a few seconds behind meaning he didnt have enough time to stop

                    It wasn't Kale's fault at all, the other car cut him off and was speeding.

                        He clearly blamed himself for his dad's death.
                        And yes he was responsible in the sense that he was driving the car, but he wasn't guilty.
