i dont a court should overrule a family decision, but that decision must exist in writing or digital and not some "he said-she said" about medical care. on the other hand, hospitals have finite space, resources, staff. should those get subordinated to the needs of one patient who in the most extreme case is non-responsive and clinicly "brain dead"?
so i say take the patient home and let the family care.
then tghere's insurance: you pay less than pennies on the dollar for a policy; should OTHER policy holders subsidize the care where costs could be millions, if the alternative is plug pulling?

** in florida way back when, a woman named terri shivo collapsed and went into a non-respomsive coma. she and the husband had nothing in writing about medical decision making. under florida law, the spouse is the sole authority to make any decison, absent any legal documentation asserting other spouce's wishes.
her parents would not accept she was "gone." they pulled every dirty trick in the book, and then some, in order to gain control over her care. the doctors told the parents she would never regain awareness or communicate. the docs had no take on whether in this condition a person was passively aware and hearing/seeing. but under florida law, she was considered brain dead.
this went on for years. some dirtball filmed the woman and then via creative editing released a video purporting to show Shivo "reacting" to stimulus and questions. it was all fake. The husband became the ground zero for hate and violence, all in the name of keeping terri "alive." The "pro-life" crowd actually had signs reading "Kill Michael Schivo" at demonstrations. go figure! Parents were catholic as well as the daughter and husband. Catholic groups shamelessly profited off the parents' grief and desire to keep the woman alive.
the parents litigated the case at the county, state, and federal levels. they lost every single case not only on first taste but on appeal. they lost in the supreme court. If memory is ok, i believe "W-yuh" called Congress back INTO session for an emergency meeting where a Bill was written granting some kind of supra-national legal status or an affirmative directive to prevent plug pulling. it passed 433-0 in House and 99-0 in the senate. Bush signed it before the electrons on the printer were done cooling down.
i think that's when the SC declined to hear the case.
after the death, the autopsy showed the poor woman's brain had suffered an irreversible lack of oxygen and her entire higher functions were dead instantly.at no point from her collapse until death was she "aware" of her condition. her body still had periodic movement due to currents naturally circulating in the body.
well meaning people can **** up a bad sistuation just as easily as a bad person can destroy a good situation. Blame God for our fragile, fickle, feeble physical bodies and the need for constant care and not the healthcare system! -
