Well, guardians of the galaxy isnt really a cross over film either. Its like Xmen or Fast and Furious. Just cause its a team doesnt make it a team up film like Avengers.

Same actors, same director, same script, same movie. The only difference between this online version and the version that will be opening in US theaters next weekend is that this online version included Spanish subtitles.

No, it's not. It would be similar to if I took my brother's copy of Microsoft Office and installed it on my computer, then that would be illegal because I've created an unauthorized and unlicensed copy of it.
But if I borrow my brother's computer and used Microsoft Office on his computer, then (even though I "robbed" Microsoft of revenue by using Microsoft Office without buying it myself) it's not illegal because I haven't created an unauthorized and unlicensed copy of it.

It's not necessarily legal. It's unenforced to date (and extremely difficult to enforce) but they could easily make a case that you're creating a copy, however ephemeral.
