You can't just say you're shooting porn as if all that's required to shoot porn is making it up on the spot. There's a process to making a porn movie - a lot of paperwork is involved.
Homemade porn that's uploaded is usually done in a private setting, a home. These instances, too, would be illegal if they're done in a public spot. Technically, any porn that has actual sex, for profit, as opposed to simulated, is illegal in all states. Nude pics are okay, unless we sell them.
Mainstream porn like Bang Bros, Reality Kings, Fake Agent, where there are outdoor scenes and scenes in commercial buildings, have to get a license first to do that. These companies always have their own lawyers working for them because state and federal authorities are watching them like a hawk.
Porn stars pay taxes on their earnings. For occupation, they're considered an actor, model, or entertainer.
And you forget, taxes must be paid to the city where a porn is filmed. If a prostitute says she's doing a "porn," she has to pay taxes on that. Police will ask them for proof or license of anything that shows any evidence they're in the porn business. -

I don’t understand why it’s illegal in america. If someone wants to sell their services for money they shouldn’t be restricted. It’s literally the definition of capitalism.

What I mean by that, is that pron is perfectly legal. Why not mask prostitution activities as "Man on the street" porn, then? You can even do it out of your car, perfectly legal. -
