Here are the facts that punch holes in that Cato-style spin.
First, yes, illegal crossings were already rising before Biden was sworn in. But that does not rescue Biden from responsibility for what followed. Even Cato’s own piece concedes that illegal immigration “more than tripled” under Biden from the 2020 level, and that Biden ended or tried to end key Trump-era deterrent policies such as Remain in Mexico. Reuters also reported that on day one Biden’s DHS moved to pause many deportations for 100 days.
Second, the raw scale under Biden was catastrophic by any normal standard. Migration Policy Institute says the administration recorded 8.6 million migrant encounters at the U.S.-Mexico border from January 2021 through October 2024, with record annual numbers in FY2022 and FY2023. Pew likewise notes Border Patrol had more than 2.2 million encounters in FY2022 and more than 2 million in FY2023. That is not a trivial continuation of a preexisting trend; it is a historic blowout.
Third, saying “Biden increased arrests, detentions, and removals” is a sleight of hand. Of course enforcement actions can rise when crossings explode. If more people show up, you can arrest and process more people and still have a worse border crisis. MPI says that despite all that activity, it estimates that by July 2024 more than 5.8 million migrants had been paroled in or otherwise allowed entry to pursue asylum or other immigration cases, and at times authorities were so overwhelmed that they had to release migrants into the country. That is the opposite of a secure border.
Fourth, the “crisis ended before he left” line is highly misleading. What actually happened is that crossings fell sharply late in 2024 after Biden moved to impose a broad asylum ban in June 2024 and after Mexico increased enforcement. Reuters reported Biden’s June 2024 order was a major enforcement move, and AP described it as his most aggressive unilateral immigration action yet. In other words, the late drop is not proof he was never the problem; it is proof that tougher restrictions mattered after years of damage.
Fifth, even if December 2024 was lower than December 2020, that does not erase the record-setting years in between. Reuters reported December 2024 Border Patrol apprehensions were about 47,000, versus 250,000 in December 2023 and 71,000 in December 2020. That supports only a narrow claim about the end point, not the broader claim that Biden was wrongly blamed. A president does not get cleared because the fire was smaller at the end after the house already burned.
Sixth, the “it was just the labor market” excuse leaves out policy incentives. Biden narrowed interior enforcement priorities, expanded parole and other entry pathways, and presided over a system where millions were allowed in pending long court processes. MPI says the administration advanced 605 immigration-related executive actions, recrafted interior enforcement priorities, created new humanitarian pathways, and restored or expanded multiple legal protections, while the border still saw record irregular arrivals and millions allowed in to pursue claims.
Seventh, “enforcement increased” also ignores the massive number of people who were not caught. A DHS OIG report said CBP recorded 389,155 gotaways in FY2021 and more than 600,000 in FY2022. So even the encounter numbers understate how badly control had deteriorated.
The clean rebuttal is this:
Biden did not invent the upward trend, but he absolutely presided over — and helped worsen — the worst border numbers in modern U.S. history.
Record encounters in FY2022 and FY2023, millions released or paroled into the country, huge gotaway totals, and only then a late crackdown in 2024. Calling that proof he was unfairly blamed is nonsense.
