Joe Biden is President, Donald Trump is not President.
You can't prosecute a sitting President.
If Joe Biden's case is indeed pretty bad then they won't be able to prosecute him until he is out of office.
Donald Trump though can be prosecuted any time (we will see what the Special Prosecutor investigating Trump will do).
