I see your point, however this film was made long before child pornography was known to be such a common crime.
No doubt an argument could be made, but to convey that the marriage was consummated it could be said nudity was essential.
Yet what we see in 2014 is much worse than what was on the screen in 1969. -

If the nudity is considered artistic, then it is not child pornography, and therefore legal.
Not only is this an example, but Brooke Shields in
Pretty Baby
, and Thora Birch in
American Beauty
both did underage nudity in films. -

As I understand it, nudity by underage actors and actresses is legal, provided two conditions are met. One is that the child's parent or legal guardian consents, and the second condition is that there is nothing sexual about the presentation.
An example may be giving the child a bath, or the kid disrobing for swimming. Reese Witherspoon did the latter for a film when she was underage, and she said in subsequent interviews that a body double was not used; that it was really her bottom that was shown. There was nothing sexualm about it, it was just a kid going swimming. I have seen other films where young children were being bathed by adults and the films showed their rear ends. There was nothing sexual intended, and so the nudity shown was legal.
So there is nothing
per se
illegal or pornographic about underage nudity, but they are very careful about it as they should be. -

That's what I don't get. Brooke's nudity in Pretty Baby and Thora Birch in American Beauty was not sexual? Brooke was parading her body before a potential client. And Birch was disrobing for her boyfriend. Were they both disrobing so they could sit down to eat a hamburger & watch TV? I don't think so.

If I am the one you are responding to, then you have the advantage over me, because I haven't seen either of those films. From your description it would appear to me that the scenes that you refer to were sexual in nature. But they were filmed and widely distributed so there might be other exceptions to the law that I don't know about.
I'm not a lawyer so I don't know if additional loopholes exist or not.
