Say no ? It was Miller's idea to make the movie. No one asked him to make it, if I understand it correctly. He got the idea while on a trip and wrote the script himself
And Mad Max is Mad Max. He's a character. Actors play characters. Mel Gibson is an actor. Tom Hardy is an actor Mad Max, like Batman or James Bond or Captain Kirk is a character.

If they had cast Mad Mel in the title role, they would've had to change the name from "Mad Max - Fury Road" to "BATS#1T F#C%IN& INSANE MAX - ROAD RAGE!!!!!11".
Sorry, but to me Hardy will always be that bald pansy from Star Trek Nemesis. The only other film I've seen with him was Bronson (which was also an utter piece of rubbish).
And yeah, Mad Max 4 sounds like a crappy cash-in.

Seeing that the man wrote all the Mad Max movies I think he can do whatever the Hell he wants with the storyline & hire whoever the Hell he wants to play them.

Yes Mad Max is Miller's baby, he can do with it what he wants.
Having said that he delegated duties to some very talented people: Brendan McCarthy (co-writer, set designer), John Seale (cinematography), Jacob Tomuri (Stunt Coordinator), Eve Ensler (female character developer). And most of all to Tom Hardy and Charlize Theron for being oil and vinegar together.
