In certain cases, the family members wanted the child, but the state sided with the killers and left the kid with their murderer
The authorities wouldn't let another family member rescue the child from being abused
One particular case, a little boy had to go back with his Native American mother, and he didn't want to. He was clinging to the woman who was taking care of him and crying
He ended up dead. He even had damage to his genitals. This is how messed up our system is

Authority can make wrongheaded decisions. It is not fool proof and there are always going to be casualties.
Children can also make up their own mind about things too and in that scenario you have cited about a little Native American Indian boy who didn't want to go back to his mother, that decision would have been made because of their indigenous status and for fear of racism claims if they didn't side with the parent.

There would have been other legal issues surrounding it. If she was unfit and he was taken away, why would she suddenly have been deemed fit when she wasn't?
