Kudos to all of you guys who wasted time and energy trying to get Bing to see the light - aint going to happen, but we were all rooting for you anyway : p
Btw, I've been on this earth for a little bit, and I've never had a sexual relationship with anyone based on money, gifts, paying my way, etc, etc. Never. Also, I've turned down guys who had alot of money because there wasn't any attraction there (also turned down real hotties too, cause the feeling wasn't there).
Wow - some of us have relationships and sex based on mutual attraction and shared feeling. And some of us women like sex for its own sake (with someone we are into).

Yeah, she wasn't justified in anything. She didn't know he was supposedly a sexual abuser or rapist or whatever. That was included in the screenplay to justify her actions. But she knew she was going to far. In her defense though, he was an idiot and should have just stopped- but no, he had to keep coming at her after she said no. So, really, I guess what happens is that some people depending upon their psychological profile will attribute this frustration about cease and desist, to her, when it was he who should have stopped first. But no, that's still no justification.

I actually thought that including his history as a sexual perpetrator weakened the storyline. Uncertainty - both in her mind and the audience's - would have been far more effective, dramatically speaking.

Would have been far more interesting if screenplay left sex crimes out altogether, and Carlos had been a low-level drug smuggler trying to make a buck & accidental murderer in a desperate situation, as Jesse's character was originally written. In my version Jesse does not kill Carlos because there was never any intention of rape or misread sexual signals.
In this imaginary version, Carlos is a Eurotrash hustler who intends only to rip-off his drug dealer, but ends up killing him in self-defense. If the Russian guy had handed over the rubles to Carlos he'd be alive, but no, he's macho & scared of what the Mafia will do to him if he does not turn in the drug money that's owed. He pulls a knife on Carlos, they scuffle, & knife ends up in dealer's head.
Carlos & Abby, completely panicked, jump onto the train, running from the Mafia &/or police. Who's to say which is worse in that part of the world? These two are just as terrified as is Jesse when Carlos dies later. A far-fetched solution arrives in the form of the two naive, nerdy Americans. Carlos figures he'll somehow stash the heroin dolls on them, so if the mafia or cops come around, the nerds will take the fall for the heist and/or dope.
Carlos' harebrained plan goes awry when he realizes the female gringo, Jesse, is street smart. He devises a new plan where he will prey on her "wild child" nature to get him to join forces with him. He dangles the bait in the form of alluring come-hither looks and some sensual Spanish phrases. She bites, saying "back in the day" he could have had his way with her. Carlos shows her the dolls, his bare a&&, muscles & tattoos at the sight of which he gambles she'll be raring to go back to her "bad girl" roots.
Fate steps in. The train to bring Roy to reunite him & Jesse will arrive very late that day. Carlos seizes his opportunity, gets Abby to scram so Carlos & Jesse are alone with nothing but time to burn. Carlos convinces Jesse to a sightseeing day trip to an obscure Church in the woods. He hopes in an isolated lair he can seduce her, somehow convince her to turn the worm & help them escape. Knowing they face certain death if the Mafia catch up to them, Carlos figures any scheme, no matter how crazy, is worth a shot.
Instead, his plan goes awry when Jesse changes her mind about making it with him. Carlos is annoyed not because he cares about the sex, but because it's part of a desperate plan to save his life. Carlos comes after Jesse to convince her he does not want to hurt her, but needs her help. Jesse misreads this as an attempt to force her have sex. Carlos comes back again, smiling, although she's just hit him in the face with a board. He tries again to to convince her he means her no harm. He stands still, holds out her camera, makes a peace sign with the other.
Jesse calms down, gingerly takes the camera and steps back, still not sure if she can trust him. Carlos does not move, but smiles. He slowly reaches out his hand to her. They shake hands in a truce. They pack snow on his head injury, drink vodka shots from his flask, take more photos & lollygag about. Have more lame conversation about how they might have gotten together in "another time".
Here there can be either of 2 versions. In version one, as the vodka kicks in, they make out some more, and end up having passionate sex in the woods. Jesse swoons. Most exciting sex she's had in years. Carlos thinks he may be able to implement his plan soon, since he's accomplished Part A- "The Physical Seduction" -perfectly.
The two hold hands, and on the way back to the bus, Carlos trips over a log and bashes his head on a rock and accidentally dies. Jesse is so freaked out, so guilty she just had sex with him, she does not know what to do.
In version 2, they do not have sex, but he still dies in the woods. Carlos could be attacked by a wolf or hit his head. Either way, Carlos must die in the woods.
When Jesse gets back to the hotel, Woody aka Roy has already arrived. Jesse arrives very upset, but Roy figures this is because she is so late from her sightseeing adventures, and nearly missed the train. He tells her to calm down, the bags are on the train. Jesse does not tell Roy about Carlos' death yet, because she's still trying to work out her story of what she was doing alone out in the woods with him, and does not want to confess to cheating on Roy. Also, Grinko [Kingsley] has shown up. Jesse realizes if she admits to being with Carlos when he died, she will have to deal with Russian police, & is leery to get involved since she's seen so much violence & corruption. Even if she did not have sex with Carlos [Version Two], and does not have any guilt, once the dolls/drug smuggling are mentioned, she puts 2+2 together & realizes Carlos was a heroin mule, & figures the best idea is to keep her mouth shut - period - and to get the hell out of Dodge.
The rest of the movie proceeds forward as written, but in the end, Jesse h -

Just watched this movie the other day. First off there's some pretty ignorant comments on this thread. A woman does have the right to make out with a guy and change her mind about going all the way. There's a difference between criminal and stupid. This character was stupid and in a way asking to get raped/murdered by going off in the woods in a strange country with a guy she doesn't know. Just because she went with him and kissed him, doesn't make it right for him to assault her, but she left herself vulnerable. If I walk into the inner city to a bad neighborhood with cash strapped to me over my clothes and get robbed, its because of my own stupidity. Its still a crime, but this is not a perfect world and one needs to protect themselves and make smart decisions.
And when I watched this scene, I didn't even get the impression he was going to rape her. I saw him rough her up a little because he was frustrated that she changed her mind, but then after her first reaction it looks like he wanted to calm things down. But she continued to freak out and hit him to death with the stick, which to me was way overboard and worthy of criminal charges (manslaughter?). I think the writers wanted us to believe that she overreacted as well, which to me implies he wasn't going to rape her. But then finding out he has a history of sexual assault, that does change our perception of the events a little. -

No. Carlos was acting in a very stupid way, but you have no right to kill people for that. It was not self defense, it was either murder or manslaughter. (To beat a defenseless and disabled person seems more like murder than manslaughter.)
I find it disturbing that she got away with it and also that it somehow becomes justified (in the movie and here at the board). Self defense does not imply the right to kill people who scare you. -

Her self defense was totally justified, but why did she KEEP hitting him? I know she was panicked, but I thought she had bashed him enough the first few times. Even though if was still conscious, he had collapsed and she could have just ran.

Because she was a nuttcase and Carlos didn't realize he was dealing with a nuttcase. He was thinking they were still having fun when she was already completely panicked. Case of some bad miscommunication.
I found it a really annoying and unrealistic scene. The fact that he later turned out to be a drugsdealer and a sexoffender didn't change anything. She at first totally wanted him and she didn't know he was a criminal when she killed him. She obviously was a very disturbed woman with some kind of violence in her past, hence her panick and agression. It really didn't get why she lied about it later on, especially with Abby being tortured. again really troubled person.
I felt really sorry for Abby and was happy she came out alive and with money in her pocket. -

The first 3 hits were alright and in self defence. But the last few blows were clearly not needed and she was trying to kill him. She hit a man in the head with a huge stick several times. But all in all I don't know what else she could have done. She could have hit him a few times and ran away. But he could have catched up with her over time I think. He could easily have found her by following the tracks she left behind. It's a lose, lose situation.
