Foreign national I suppose. It really depends on what they do next. They might just reapply for asylum or they might leave/get deported. Just because they get denied doesn't automatically mean they become an illegal immigrant.

But you said it in response to a post which asked (sarcastically) if asylum seekers should also be shot along with illegal immigrants. This suggests that it's okay to shoot them as soon as they become (officially) illegal immigrants.
