Yep they get due process. If they didn't want to be deported they should have entered legally. -

You don't need to be guilty of a crime for law enforcement to arrest you.
Law enforcement doesn't need a warrant to make an arrest.
Being arrested doesn't mean you don't get due process. Why are you giving criminals so much leeway? Do you want murderers and rapists just running around free until they are found guilty in court? -

Are the police omniscient? No, of course not. What a stupid question Holly. Police make arrests based on available evidence. That doesn't always mean someone will be found guilty of what they were arrested for in a court of law.
You don't need a warrant to be arrested and being arrested doesn't mean you will not have due process. This is how it works for both citizens and non-citizens.
