It is not the substance that matters, dum dum.
It is the intent and who is being attacked.
I believe the laws apply differently to those in public service than you or me since they are the ones that need the protection more so.

Again, the substance doesn't matter.
If you still think your boy is being unfairly charged then write to the DA and others who will have an impact to try and get him out of jail so he can do worse to someone else next time.

I don't know. That DC guy that threw a sandwich was being charged with felony assault until the prosecutor couldn't get a grand jury to agree. Then the downgraded charges in his actual trial ended up being not guilty either.
